License Agreement

En-Safe is the owner and authorized licensor of all intellectual property rights (including copyright) in the data product referred to as An ABC Guide to Best Practice. En-Safe grants to the user (licensee) a non-exclusive, non-assignable and non-transferable royalty free licence to use the data product subject to the terms of this agreement.

The licence is not a sale of any or all of En-Safe's rights. This data product may only be used by authorized users. This data product is supplied strictly for its intended use and purpose. The data product shall not be copied in whole or in part. No copy of the data contained in the data product my be made except for internal use only.

The data product supplied under this agreement shall at all time remain under the control of the user or licensee. It may not be sold, rented, leased, lent, sublicensed or transferred to any other party without the express written approval from En-Safe and may not be traded or exchanged for any other product or service. The data product may not be used for personal or commercial gain of any authorized user, nor to develop or derive for sale any other data product that incorporates or uses any part of this data product.

This data product is provided "as is", and En-Safe make no warranty, either expressed or implied, including but not limited to warranties of merchantability and fitness for any other purpose except as express herein. In no event shall En-Safe be liable for any direct, indirect, special, incidental or consequential damages however caused resulting for the use of the data product.

The licensee will be responsible for the management of the data product and communication of these terms and conditions to all authorized internal users. The licensee will ensure that the use of this data product complies with these terms and seek prior written permission from En-Safe for any uses not permitted or not specified in this agreement. The licensee is responsible for distributing within it organization to authorized personnel only; it shall not be posted on an internet website. It is a condition of this agreement that only authorized user shave have access to this information. Failure to comply with any terms of this agreement will result in termination of this agreement and at the discretion of En-Safe punitive damages.

Additional Copyright Information
General Contractors
A General Contractor can post this material to be read (i.e. in a job site trailer but not on their web site or in their contract administration). For any General Contractor who would like to copy or distribute this information to their sub-contractors, a licensed agreement must be purchased. Documents are based on single user license agreement which can be copied for internal use only.

Associations and Safety Groups
For any Association or Safety Group who would like to copy or distribute this information to their members, a licensed agreement must be purchased. Documents are based on single user license agreement which can be copied for internal use only.

Consultants
For Consultants wishing to use our intellectual property for consulting to their Clients, a licensed agreement must be purchased. Documents are based on single user license agreement which can be copied for internal use only. Branding may be available.

Suppliers / Distributors
Suppliers and Distributors shall abide by the license agreement to copy or distribute our product. Branding may be available.

Legislation Affiliations
If Legislative affiliations wish to adopt any of En-Safe's intellectual property, please contact our office.

Proprietary Rights Notice

The information contained in this document is confidential and proprietary to En-Safe. No disclosure to others, either in Canada, United States or abroad, or reproduction of any part of the information supplied is to be made, and no manufacture, sale, or use of any invention or discovery disclosed herein shall be made, except by written authorization of En-Safe. This notice will not operate to nullify or limit rights granted by contract. The data subject to this restriction is contained in all sheets and is to be disclosed for the purpose(s) of internal use and distribution only and other parties that receive written authorization from En-Safe.
